The short version. AI Upscaler Studio runs on your own computer. The images you upscale are processed locally on your GPU and are never uploaded to us or anyone else. We don't run ads, we don't track you, and we don't sell data. The details below explain the few cases where any information leaves your device at all.
This policy explains how S.M. Digital ("we", "us") handles information in connection with the AI Upscaler Studio desktop application ("the App") and the website getupscalerstudio.com ("the Site"). We are the data controller. You can reach us through our support form.
AI Upscaler Studio performs all image upscaling locally, using your computer's NVIDIA GPU. The images you open, the upscaled results, and any watch-folders you configure never leave your device and are never transmitted to us. We have no servers that receive, store, or see your images.
To keep the download small, the App fetches its AI model files on first run. There are also a couple of cases tied to licensing. In each case below, the data that leaves your device is limited to what's described.
On first launch (and when a model is missing), the App downloads model files over HTTPS from a content host. As with any web request, that host receives your IP address and standard request information. No personal data is sent by us, and the request contains nothing about your images.
How your purchase is handled depends on where you bought the App:
For your license, the App computes a one-way hash derived from basic machine characteristics to bind your license to a single computer and prevent key sharing. This value cannot be reversed to identify you personally; it is stored locally and, for direct purchases, sent to our license server during activation only.
If the App offers an optional cloud-upscaling mode and you choose to use it with your own third-party API key, the specific image you select is sent to that third-party service using your key, subject to that provider's terms. This is entirely optional and never happens unless you turn it on.

Some of these providers are based outside the EU/EEA (for example, in the United States). Where that involves a transfer of personal data, it is carried out under appropriate safeguards such as the EU Standard Contractual Clauses or an applicable adequacy framework.
Data the App stores (model files and your local activation file) remains on your device until you delete it or uninstall the App. Support emails are kept only as long as needed to help you and to keep records of any purchase. Our processors retain purchase records according to their own policies and legal obligations.
Depending on where you live, you may have the right to access, correct, delete, restrict, or object to the processing of your personal data, and to data portability. Because most data lives only on your own device, you can exercise much of this directly by deleting your local activation file or uninstalling the App. For anything else, use our support form and we will respond. EEA/UK users also have the right to lodge a complaint with their local data protection authority.
The App and Site are not directed to children under 16, and we do not knowingly collect personal data from them.
We may update this policy as the App and Site evolve. Material changes will be reflected by the "Last updated" date at the top of this page.
